Terms of Service

Effective Date: March 1, 2026

This is an English translation of the Terms of Service originally written in Japanese. In the event of any discrepancy between the Japanese version and this English translation, the Japanese version shall prevail.

Article 1 (Scope and Definitions)

  1. These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions of use of "Nyanko Database" (hereinafter referred to as "the Service") operated by Kamineko LLC (hereinafter referred to as "the Company"), between the Company and all persons who use the Service (hereinafter referred to as "Users"). Users shall use the Service upon agreeing to these Terms.
  2. The definitions of terms used in these Terms are as follows:
    • "General User" refers to a User who browses cat cafe information, posts reviews, subscribes to Oshi Neko Plans, purchases and uses Nyanko Coins, and engages in similar activities on the Service.
    • "Shop User" refers to a User who manages cat cafe shop information, sets up and provides Oshi Neko Plans, and engages in similar activities on the Service.
    • "Nyanko Coin" (hereinafter referred to as "NC") refers to digital currency that can only be used within the Service and can be purchased or obtained through methods designated by the Company. Users hold only the right to use NC and do not hold ownership or any other property rights therein.
    • "Paid NC" refers to NC purchased by a User in exchange for monetary payment.
    • "Free NC" refers to NC granted to a User free of charge by the Company through campaigns, bonuses, promotions, or similar means.
    • "Oshi Neko Plan" refers to a system whereby a General User subscribes to a monthly plan set by a Shop User and pays NC to support a cat.
    • "Tip" refers to a system whereby a General User sends an arbitrary amount of NC to a Shop User.
  3. Guidelines, help pages, notices, and other rules posted by the Company on the Service (hereinafter referred to as "Supplementary Rules"), regardless of their titles, shall constitute a part of these Terms. In the event of any discrepancy between these Terms and any Supplementary Rules, the Supplementary Rules shall prevail.

Article 2 (User Registration)

  1. Persons wishing to use the Service shall agree to these Terms and apply for user registration through methods designated by the Company (registration using an email address and password, or registration using an account of an external service such as Google or X (formerly Twitter)).
  2. The Company may decline to approve a registration application if the applicant falls under any of the following categories. The Company is under no obligation to disclose the reasons for such decision.
    • The applicant has provided false information in the registration application.
    • The applicant has previously had their account suspended or deleted due to a violation of these Terms.
    • The Company determines that the applicant is an anti-social force (including organized crime groups, their members, right-wing organizations, anti-social forces, or persons similar thereto), or is involved in providing funding or otherwise cooperating with, participating in, or engaging with anti-social forces in any manner.
    • The Company otherwise determines that user registration is not appropriate.
  3. Users shall promptly update their registration information through methods designated by the Company whenever any changes occur.

Article 3 (Account Management)

  1. Users shall manage their account information for the Service (including user ID, password, and linked external service information) properly under their own responsibility.
  2. Users may not, under any circumstances, transfer, lend, or share their account with any third party.
  3. When a login is made using a user ID and password combination that matches the registered information, or through a linked external service account, such use shall be deemed to have been made by the User who registered that account.
  4. The Company shall not be liable for any damages caused by unauthorized use of an account by a third party, except where the Company is found to have acted with intent or gross negligence.

Article 4 (Nyanko Coins)

  1. NC is digital currency that can only be used within the Service. NC holds no value whatsoever outside of the Service.
  2. Users may purchase NC using payment methods designated by the Company (such as credit cards) in accordance with the purchase units and prices separately determined by the Company. The purchase units and prices of NC shall be determined by the Company from time to time and displayed on the Service.
  3. A confirmation screen will be displayed during the NC purchase process. Users shall confirm the purchase details before finalizing their purchase.
  4. NC may be used for the following purposes. However, the availability of each function may vary depending on the development and operational status of the Service.
    • Monthly payments for Oshi Neko Plans
    • Sending Tips to Shop Users
    • Obtaining titles, badges, and other digital items
    • Other uses separately determined by the Company
  5. NC cannot be converted, refunded, reimbursed, or exchanged into Japanese yen or any other currency for any reason. However, where a refund is required by law, such refund shall be made through methods separately determined by the Company.
  6. NC cannot be transferred, lent, sold, pledged, or otherwise disposed of to any third party.
  7. Users may check their NC balance on the Service. While the displayed balance may temporarily be inaccurate due to communication failures, system failures, or other causes, the balance recorded on the Company's servers shall be the official balance.
  8. After the NC purchase process is completed, the Company will not accept cancellations or refunds, except where the Company is found to have acted with intent or gross negligence, where unauthorized use of a payment method has been confirmed, or where required by law.

Article 5 (Expiration and Forfeiture of Nyanko Coins)

  1. The expiration date of Paid NC shall be 6 months from the date on which such NC was recorded in the User's balance (hereinafter referred to as the "Issue Date"). Paid NC that has passed its expiration date shall automatically expire and cannot be used.
  2. The expiration date of Free NC shall be 6 months from the date on which such NC was recorded in the User's balance (hereinafter referred to as the "Grant Date"). Free NC that has passed its expiration date shall automatically expire and cannot be used.
  3. When using NC, regardless of whether it is Paid NC or Free NC, NC with the earliest expiration date shall be consumed first.
  4. Expired NC will not be restored, supplemented, or compensated. However, this shall not apply where a system failure attributable to the Company's intent or gross negligence prevented the User from using NC before its expiration, in which case the Company shall take appropriate measures within a reasonable scope.
  5. The Company shall display information regarding NC expiration dates (including the expiration date and the quantity of NC subject thereto) on the Service. Users shall manage expiration dates under their own responsibility.
  6. The Company shall endeavor to notify Users by email or through notifications on the Service before NC expiration dates arrive; however, the failure to receive such notification shall not invalidate the expiration of NC.

Article 6 (Oshi Neko Plans)

  1. General Users may subscribe to Oshi Neko Plans set up by Shop Users on the Service. The name, price (NC amount), and content of Oshi Neko Plans shall be set by the Shop User.
  2. The monthly fee for an Oshi Neko Plan shall be automatically deducted from the User's NC balance on the same day of each month, calculated from the date on which the General User subscribed to the Plan (where such day does not exist in a given month, the deduction shall occur on the last day of that month).
  3. If the NC balance is insufficient to cover the monthly fee on the deduction date, the Oshi Neko Plan shall be automatically suspended. In such case, the benefits associated with the Plan and the consecutive support record shall also be interrupted.
  4. General Users may subscribe to multiple Oshi Neko Plans simultaneously (including different plans from the same shop or plans from different shops).
  5. General Users may cancel an Oshi Neko Plan at any time. Upon cancellation, the Plan shall remain effective until the day before the next deduction date, and no further deductions shall be made from the next deduction onward. However, in the case of account withdrawal pursuant to Article 14, the provisions of that Article shall take precedence.
  6. If a Shop User changes the price of an Oshi Neko Plan, the Company shall notify the General User accordingly. After receiving such notification, the General User may choose to continue the Plan at the revised price or cancel the Plan. The revised price shall apply from the next deduction date.
  7. The content of benefits provided by Shop Users under Oshi Neko Plans (such as access to exclusive posts, visit benefits, etc.) is set and provided under the responsibility of the Shop User, and the Company does not guarantee their content, quality, or continuity of provision.

Article 7 (Tips)

  1. General Users may send an arbitrary amount of NC as a Tip to Shop Users on the Service.
  2. A Tip is finalized at the point when the sending operation is completed, and cannot be cancelled, returned, or modified after sending.
  3. A confirmation screen will be displayed before sending a Tip. Users shall confirm the recipient and the amount before sending.

Article 8 (Provisions Regarding Shop Users)

  1. Shop Users may manage shop information and set up Oshi Neko Plans on the Service through methods designated by the Company.
  2. Shop Users may freely set and modify the name, price (NC amount), and benefit details of Oshi Neko Plans within the scope determined by the Company.
  3. A portion of the NC used by General Users for monthly Oshi Neko Plan payments or Tips shall be converted into Japanese yen and distributed to the Shop User based on the distribution rate and calculation method separately determined by the Company. For details on the distribution rate and calculation method, please refer to the Shop User Guidelines (https://nyankodb.com/shop-guidelines) separately established by the Company.
  4. Transfer of distribution payments to Shop Users shall be made by the Company's designated method in accordance with the Shop User Guidelines (https://nyankodb.com/shop-guidelines) separately established by the Company. The allocation of transfer fees shall be as set forth in the said Guidelines.
  5. Shop Users are obligated to faithfully fulfill the benefits they have agreed to provide to General Users under Oshi Neko Plans.
  6. Shop Users shall endeavor to maintain accurate and up-to-date shop information (including business hours, address, resident cat information, etc.) posted on the Service.
  7. If it becomes difficult for a Shop User to continue providing an Oshi Neko Plan due to shop closure, transfer of resident cats, or other circumstances, the Shop User shall promptly report to the Company and, after consulting with the Company, take appropriate measures regarding affected General Users (including Plan cancellation, alternative arrangements, etc.).
  8. If the Company receives a complaint from a General User regarding a Shop User's failure to fulfill benefits or other matters, the Company may, as necessary, conduct an investigation and take measures it deems appropriate against the relevant Shop User, including requesting improvements, restricting Plan settings, and other actions.

Article 9 (Campaigns and Bonuses)

  1. The Company may grant Free NC to Users as new registration bonuses, referral bonuses, login bonuses, event rewards, and other campaigns and bonuses.
  2. The details, conditions, amounts, and duration of campaigns and bonuses shall be separately determined by the Company.
  3. The Company may modify or terminate the content of campaigns and bonuses without prior notice.
  4. If benefits of a campaign or bonus are obtained through fraudulent means (including, but not limited to, creating multiple accounts, using automation tools, etc.), the Company may cancel such benefits, suspend the account, or take other measures the Company deems appropriate.

Article 10 (Titles, Badges, and Rankings)

  1. The Company may grant titles, badges, and other digital items (hereinafter referred to as "Titles, etc.") to Users based on their activity record, or provide them in exchange for NC.
  2. Titles, etc. can only be displayed and used within the Service and hold no monetary value.
  3. The Company may provide rankings, competitive events, and other features on the Service. The results thereof may be displayed on the Service.
  4. The Company may modify the types, acquisition conditions, display methods, ranking calculation methods, and other aspects of Titles, etc. without prior notice.

Article 11 (Prohibited Activities)

  1. Users shall not engage in the following activities when using the Service:

    (General Prohibitions)

    • Activities that violate laws, regulations, or public order and morals
    • Activities related to criminal acts
    • Activities that destroy or interfere with the functionality of the Company's servers or networks
    • Activities that may interfere with the operation of the Service
    • Activities that collect or accumulate personal information of other Users
    • Unauthorized access or attempts thereof
    • Impersonating other Users
    • Activities that infringe upon the intellectual property rights, portrait rights, privacy rights, reputation, or other rights or interests of third parties
    • Posting or transmitting false or misleading information
    • Providing benefits to anti-social forces

    (Prohibitions Related to NC and Payments)

    • Fraudulently obtaining, duplicating, or tampering with NC
    • Converting or attempting to convert NC into Japanese yen, other currencies, crypto assets, property, or other economic benefits
    • Transferring, trading, or pledging NC to third parties
    • Creating multiple accounts to fraudulently obtain campaign or bonus benefits
    • Using automation tools (bots), scripts, or other technical means to fraudulently obtain NC
    • Using another person's credit card information or other payment methods to fraudulently purchase NC

    (Prohibitions Related to Content)

    • Posting false content or manipulating ratings in cat cafe reviews
    • Manipulating rankings through fraudulent means in ranking or other competitive features
    • Engaging in commercial advertising, promotion, solicitation, or similar activities contrary to the purpose of the Service
  2. If the Company determines that a User has engaged in, or is likely to engage in, any of the prohibited activities set forth in the preceding paragraph, the Company may, without prior notice, take the following measures against such User:
    • Restriction or suspension of use of the Service
    • Deletion of the account
    • Forfeiture of NC balance (including Paid NC)
    • Other measures the Company deems necessary

Article 12 (User-Generated Content)

  1. In this Article, "User Content" refers to all content posted, transmitted, or published by a User on the Service (including, but not limited to, reviews, comments, photos, Oshi Neko Diary entries, etc.).
  2. Users warrant to the Company that they have the legal right to post or otherwise transmit User Content, and that such User Content does not infringe upon the rights of any third party.
  3. Users grant the Company a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, distribute, create derivative works of, display, and perform User Content. This license shall survive even after the User withdraws from the Service.
  4. Users shall not exercise moral rights of authorship with respect to User Content against the Company or persons authorized by the Company.
  5. The Company may delete User Content without prior notice if it determines that such content violates these Terms or applicable laws.

Article 13 (Intellectual Property Rights)

  1. Intellectual property rights related to content provided by the Company through the Service (including, but not limited to, text, images, videos, audio, designs, logos, programs, etc.) belong to the Company or legitimate rights holders.
  2. Some images used in the Service are obtained from Wikimedia Commons and are used in accordance with their respective license terms.
  3. Intellectual property rights related to the design of titles, badges, Oshi Neko Cards, and other digital items belong to the Company. Users may use these within the scope of features provided by the Service, but use outside the Service (excluding sharing through the SNS share function) requires prior permission from the Company.

Article 14 (Account Withdrawal)

  1. Users may withdraw from the Service and delete their account at any time through methods designated by the Company.
  2. Upon withdrawal, all NC balance held by the User at the time of withdrawal (regardless of whether Paid NC or Free NC) shall immediately expire. No refunds, supplements, or other compensation shall be provided for expired NC, except where required by law.
  3. The Company shall display a notice during the withdrawal process if the User has any remaining NC balance.
  4. Upon withdrawal, all active Oshi Neko Plans shall be immediately cancelled. In this case, notwithstanding the provisions of Article 6, Paragraph 5, the Plan shall terminate at the time of withdrawal.
  5. Upon withdrawal, User Content posted by the withdrawing User may continue to be displayed on the Service after anonymization processing, such as changing the user name to "Withdrawn User." Users who wish to delete their User Content before withdrawal should do so themselves before completing the withdrawal process.
  6. Accounts cannot be restored after withdrawal. Users who wish to use the Service again must complete a new user registration.

Article 15 (Use by Minors)

  1. Minors who use the Service (including, but not limited to, purchasing NC) must obtain the consent of their legal representative (parent or guardian) before use.
  2. If a minor purchases NC or engages in other paid transactions without the consent of their legal representative, such transactions may be rescinded pursuant to the provisions of the Civil Code.

Article 16 (Suspension of the Service)

  1. The Company may temporarily suspend or interrupt all or part of the Service without prior notice to Users if the Company determines that any of the following circumstances exist:
    • When performing maintenance, inspection, or updates to computer systems related to the Service
    • When it becomes difficult to provide the Service due to earthquakes, lightning, fire, power outages, natural disasters, or other force majeure events
    • When computers or communication lines are shut down due to an accident
    • When the Company otherwise determines that it is difficult to provide the Service
  2. If a suspension or interruption of the Service affects Oshi Neko Plan deductions, NC purchase processes, or other transactions, the Company shall endeavor to take appropriate action after service recovery; however, the Company shall not be liable for any damages incurred by Users as a result, except where the Company is found to have acted with intent or gross negligence.

Article 17 (Disclaimer)

  1. The Company makes no express or implied warranty that the Service is free from defects in fact or in law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, and infringement of rights). The Company shall not be liable for any damages incurred by Users due to defects in the Service, except where the Company is found to have acted with intent or gross negligence.
  2. Medical-related information provided through the Service, such as information on cat breed diseases, is intended for general informational purposes only and is not a substitute for diagnosis, treatment, or advice by a veterinarian or other professional.
  3. The Company does not guarantee the content, quality, or fulfillment of benefits provided by Shop Users under Oshi Neko Plans. Disputes regarding benefits provided by Shop Users shall be resolved between General Users and Shop Users. However, the Company may take measures set forth in Article 8, Paragraph 8 based on complaints from General Users, and the Company shall be liable in cases of intent or gross negligence.
  4. The Company does not guarantee the business status of Shop Users' shops (including closures, changes in business hours, transfer of resident cats, etc.). The Company shall not be liable for any damages incurred by Users due to changes in a shop's business status, except where the Company is found to have acted with intent or gross negligence.
  5. The Company shall not be liable for cases where NC cannot be purchased due to failures, suspension, or other causes of third-party payment services (including credit card payment services) used in the Service, except where the Company is found to have acted with intent or gross negligence.
  6. The Company shall not be liable for any delays, interruptions, or inability to provide the Service caused by natural disasters, war, riots, civil disturbances, enactment or amendment of laws, orders of public authorities, strikes, communication line failures, or other force majeure events.
  7. The Company shall not be liable for any disputes arising between Users or between Users and third parties, except where the Company is found to have acted with intent or gross negligence.

Article 18 (Changes to and Termination of the Service)

  1. The Company may change the content of the Service or terminate the provision of the Service at its discretion.
  2. If the Company terminates the provision of the Service, the Company shall notify Users at least 90 days before the termination date.
  3. Upon termination of the Service, Users' NC balances (regardless of whether Paid NC or Free NC) shall expire. However, for unused Paid NC balances, where required by law, the Company shall process refunds through methods and within periods separately determined by the Company. Even where there is no legal obligation to do so, the Company shall consider appropriate measures regarding unused Paid NC balances within a reasonable scope.
  4. Except as provided in the preceding paragraph, the Company shall not be liable for any damages incurred by Users due to changes to or termination of the Service, except where the Company is found to have acted with intent or gross negligence.

Article 19 (Amendments to the Terms of Service)

  1. The Company may amend these Terms if any of the following conditions are met:
    • The amendment is in the general interest of Users.
    • The amendment does not conflict with the purpose of these Terms, and is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other circumstances relating to the amendment.
  2. When amending these Terms, the Company shall publicize the amended content and the effective date a reasonable period before the effective date, by posting on the Service, sending an email to the registered email address, or other methods the Company deems appropriate.
  3. Notwithstanding the preceding paragraph, for amendments that may have a significant impact on Users' economic interests, such as NC purchases, usage, expiration, Oshi Neko Plan fee deductions, or Tips, the Company shall notify Users at least 30 days before the effective date.
  4. If a User uses the Service after the effective date of the amended Terms, such User shall be deemed to have agreed to the amended Terms.

Article 20 (Handling of Personal Information)

The handling of Users' personal information shall be governed by the Privacy Policy (https://nyankodb.com/privacy) separately established by the Company. Users shall agree to the Privacy Policy when using the Service.

Article 21 (Notices)

  1. Notices from the Company to Users shall be made through the notification function on the Service, by sending an email to the registered email address, by posting on the Service, or by other methods the Company deems appropriate.
  2. When a notice is made by email, it shall be deemed to have been delivered at the time the Company sends the email to the User's registered email address. When made by posting on the Service, it shall be deemed to have been delivered at the time of posting.

Article 22 (Damages)

If a User causes damage to the Company in violation of these Terms, the User shall be liable to compensate the Company for such damage (including reasonable attorney's fees).

Article 23 (Severability)

If any provision or part thereof of these Terms is determined to be invalid or unenforceable under applicable laws, the remaining provisions of these Terms and the remaining parts of any provision partially determined to be invalid or unenforceable shall continue to be in full force and effect.

Article 24 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. In the event of any dispute arising in connection with the Service, the Tokyo District Court shall be the exclusive court of first instance.

Supplementary Provisions
These Terms shall take effect on March 1, 2026.
The previous Terms of Service established on August 3, 2025 shall be abolished upon the effectuation of these Terms.
